The terms and conditions for use of the Nightingale website are detailed below and should be read carefully. We may vary these terms from time to time, without notice, and therefore you should check them before you make a new purchase.
Please note, any use of this website or purchase made through this website constitutes an agreement to abide by the terms and conditions detailed below which shall override any other terms and conditions. Any contracts or agreements formed between you and us by means of this website shall be governed and construed according to English law and any disputes or proceedings shall be subject to the exclusive jurisdiction of the English courts.
We have taken care in presenting the products on our website as accurately as possible. The images you see will depend on your monitor's display and colour capabilities. We are therefore unable to guarantee that the product images you see are an accurate representation of the actual merchandise. Before you place an order you should read the Delivery Information and Returns Policy.
All credit, debit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.
In addition, in the interests of preventing fraudulent use of credit, debit and charge cards, we will validate the names, addresses and other information supplied during the order process against commercially available records (e.g Electoral Roll data, Credit Reference Services). A third party may also be instructed to complete these checks. By ordering from the Nightingale.co.uk website you consent to such checks being made. We may need to contact you by letter, telephone or email to verify details before we are able to process and dispatch your order, or we may be unable to accept your order. Any information given may be disclosed to a registered Credit Reference Agency which may keep a record of the information.
All information provided will be treated in accordance with the Data Protection Act 1998. These measures are taken as extra protection for you, to ensure your online shopping experience with us is as safe and secure as possible.
Once you have completed an online purchase, we will send you an email confirming your order details.
Goods will not be despatched until payment collection has been successful.
Whilst we are under no obligation to accept your order, we would normally do so where:
- the product is available
- the order reflects current pricing
- your credit card/debit card payment is approved by your credit card/debit card company and
- your order passes our verification checks
We cannot accept orders from persons under the age of 18.
When will my order be delivered?
All orders received online at Nightingale’s are processed and, depending on stock availability, are despatched as promptly as possible.
As you know many Nightingale products are made for you so the delivery times can vary from product to product. For all ‘made for you’ items the delivery time is longer than for standard goods. The expected delivery time is noted by each item on the website. If you are unsure please call the sales helpline on 01904 211087 for advice prior to placing your order.
How do I know exactly when my order will be delivered?
If you have selected a residential or business address for delivery, once you have received your despatch confirmation your delivery will be due the following business day.
If your order has not been received within the agreed times please contact us and we will ascertain the location of the parcel and take any steps to conclude the delivery as speedily as possible.
These terms and conditions do not affect your statutory rights.

We will be pleased to meet for a bespoke consultation at our showroom in Barcleycorn Yard, York. Bespoke jewellery consultations are by appointment only and our designer is always available on a Wednesday for design consultations and can be available on other days by request. Appointments are available on weekdays but we are happy to make appointments on Saturdays or Sundays if necessary. We try to ensure that all product information and pricing displayed on the website is correct and up to date at the time you place an order. All prices shown on the website are inclusive of VAT.
We are only human and occasionally may make a mistake however we do take accuracy very seriously and endeavour to present the most recent, most accurate, and most reliable information on our website at all times. However, there may be occasions when some of the information featured may contain incomplete data, typographical errors, or minor inaccuracies. Any errors are genuine mistakes and we apologise if erroneous information is reflected in merchandise price or item availability.
We reserve the right to amend errors or to update product information at any time without prior notice.
All products and/or services displayed on this website are subject to availability and sometimes there may be factors outside of our control that affect our ability to supply goods. Prices of products may change from time to time. We will confirm availability and price at the time your order is placed. In the very unlikely event that a product is unavailable when we come to despatch your order, we will contact you either by phone or email, we may offer an alternative product of a higher value at no extra charge and if this is acceptable will dispatch without delay.
Credit/Debit Card Payment
We take online safety very seriously and take measures to protect cardholders against online fraud.
We take every reasonable care to ensure that your order and subsequent transactions are conducted in a secure environment. If products are not available for any reason after we have accepted your order, we will contact you within 24 hours to discuss alternative products. If an alternative is not suitable we will refund any amounts already paid (if any) by way of a credit to your credit card/debit card account. If an item is out of stock and you don’t want to consider an alternative and you are unable to wait for a longer delivery window we will refund your card with the amount paid.

We will communicate with you in the first instance by email. Therefore please ensure the email address you provide us with is correct. All order and despatch confirmations will be sent to the email address you provide. In the unlikely event of a problem with your order, we will contact you by telephone. Again, please ensure the contact telephone numbers you provide are accurate.
The Nightingale 10-year Diamond Promise
At Nightingale we are proud of our reputation as suppliers of quality jewellery.
We are pleased to offer a 10 year Diamond Promise on all certificated items.
The diamond purchase detailed on the certificate is guaranteed against flaws in workmanship, for a period of ten years from the date of purchase.
If you feel that your item is subject to a manufacturing fault please call 01904 211087 or email us at email@example.com. You will need to include a copy of the certificate and your receipt. After inspection, should the fault be found to be of a manufacturing origin, Nightingale will then implement full remedial work at no expense to you.
- The 10 year diamond promise is null and void should any work be carried out on the item by a third party jeweller.
- The 10 year diamond promise does not cover loss or damage caused by accident, misuse, neglect or normal wear and tear.
- The 10 year diamond promise is not transferable and does not affect your statutory rights.
If the item you receive is of unsatisfactory quality, unfit for purpose or not as described, you have a right to reject the item under the Consumer Rights Act 2015 and get a full refund.
If an item is faulty and needs to be returned, you must let us know and return the faulty item within 30 days of taking ownership of the item. We will cover the cost of you returning the item to us.
Nightingale will provide a full refund or exchange should you receive a faulty item or be unsatisfied with an item received on the following conditions:
Our promise to replace the item or refund your money does not apply to faults or damages caused by accident, neglect or misuse.
Except in relation to faulty or incorrectly supplied goods, where your statutory rights are unaffected, personalised goods or goods made to a customer's specifications may not be returned. This includes any item that has been modified or items that have been produced from specially ordered or hand made component parts, including jewellery containing lab grown diamonds.
This does not affect your statutory rights.
Under the Consumer Contracts Regulations, you have the right to cancel your order with us made at a distance at any time from the moment you place your order until 14 days from receiving your order from us. In the event we are unable to deliver your order within our standard delivery timescales you are entitled to cancel your order with no penalty. Should you cancel the contract we will then refund you the price you have paid for the goods. You are under a duty to take reasonable care of the goods, which means the goods must be unused and in pristine condition. Please contact our customer service team should you wish to cancel your order on 01904 211087. Lab grown diamonds are supplied to order and we give you the option to view the certificate prior to purchase. As these items are specially ordered they fall outside of our return policy.
The distance selling regulations do not apply to bespoke, personalised or modified items.
Statutory rights are not affected.
Even though packages are sent via Royal Mail Special Delivery, on rare occasions we do experience losses whilst in transit. Please get in touch with our customer service team if you think this may be the case with your order.
Please be aware that if we are not contacted within 30 days, an insurance claim cannot be made and thus the customer will be unable to claim any loss from Nightingale.
A signature will be required to receive the order and you will be responsible for the products as soon as they are delivered. Ownership of the products shall pass to you once we have received payment in full.
If you decide to have your order delivered to an address different from your own, a signature will still be required and the general conditions of delivery will remain unchanged. We reserve the right, for security reasons, to deliver to the billing address only, even if a different delivery address has been requested. This is for your protection and we will always inform you of this prior to despatch to ensure there will be someone available to sign for the package,
